A Local union group ( AFSCME Local 402)  with a  membership of more than 650 members of which approx.85% are of  Haitian decent work for the Department Of Developmental Services (DDS) Formerly known as the  Department of Metal Retardation.

1. The purpose of the meeting is to discuss ways to best respond to the victims of the earth quake in Haiti.( i.e. fund raising, clothes drive and emergency supplies) .

2. Gov. Patrick's  Administration is slated to close the Fernald Center the in June of this year that will potentially result in hundreds of layoffs. We will be discussing the impact of those layoffs and the crippling affect it will have on the families of the people of Haiti who heavily depends on those employees as family for survival and financial assistance.

Workers of Haitian descent at the Walter E. Fernald Developmental Center say the institution's impending closing could hurt their ability to help their families living in the earthquake-stricken Caribbean nation.
Members of Local 402 of the American Federation of State, County and Municipal Employees (AFSCME) have scheduled a press conference at 4 p.m. tomorrow at Fernald with a dual agenda: First, to organize relief efforts for earthquake victims, and second, to discuss how closing Fernald and the potential layoffs could hurt those victims.
Fernald, on Trapelo Road, is the nation's oldest publicly funded institution that serves people with developmental disabilities.
Pharamond Conille, vice president of Local 402, said the union consists of about 650 members employed by the state Department of Developmental Services - mainly direct care providers at Fernald. Of that workforce, he said about 85 percent are of Haitian descent.
Conille said workers at Fernald have been worried about losing jobs since Gov. Deval Patrick announced plans to close the institution by July 1.
The Jan. 12, magnitude-7 earthquake that killed an estimated 150,000 has added to their worries, he said.
Workers who send money or other support to their families in Haiti may not be able to provide it if they don't have a job, he said.
"That is doubly traumatizing," Conille said.
Conille said union members of Haitian descent hope tomorrow's conference will let the governor know how closing Fernald could affect Haiti.
"Considering the catastrophe and that the whole world is involved with helping (the relief effort), we're calling for the governor to look at that," he said.
Conille said relatives of many union members were killed in the earthquake. One man, he said, lost eight family members.
Conille, who was born in Port-au-Prince, said he and his wife have also tragically felt the brunt of the quake.
"I've lost cousins, she's lost aunts and nieces," he said.
Conille said Fernald workers are also concerned about the effect closing Fernald would have on its longtime residents who would be sent to community-based settings.
The Patrick administration has said that Fernald has become too expensive to operate and that equal or better care could be provided at community settings.
During tomorrow's press conference, Conille said union members would talk about possible fundraising efforts for the earthquake victims. With the help of the AFSCME's main headquarters in Washington, D.C., Conille said the local union is hoping to raise more than $30,000 for them.
In addition, Conille said Local 402 would start a clothing drive and hopes to also bring in emergency supplies as well.
Conille also said the union hopes to come up with enough money to allow a "small contingent" from its group to travel to Haiti soon to help with relief efforts there.

WALTHAM — Workers at the Walter E. Fernald Developmental Center yesterday asked the governor to reconsider closing the institution, a move they say would have repercussions felt all the way in earthquake-ravaged Haiti.

The state plans to close Fernald by July. About 85 percent of the some 650 members of Local 402 of the American Federation of State, County and Municipal Employees (AFSCME) - mostly direct care workers at Fernald - are either from Haiti or are of Haitian descent.

Fernald's closure and resulting layoffs would harm employees' efforts to provide for family members living in Haiti, union officials said at a press conference yesterday.

"This closing could not have come at a worse time," said Pharamond Conille, vice president of Local 402. "The employees here have a lot of families that need financial assistance.'

Raymond McKinnon, president of Local 402, said union members were upset with Gov. Deval Patrick's plan to close Fernald, not only the impact it would have on longtime residents, but also workers and their families - some of whom live in the impoverished Caribbean nation.

"I'm going to tell you, (Patrick is) not getting our vote," McKinnon said.

Conille, who was born in Port-au-Prince, said members of the union have worked at Fernald an average of 21 years.

Meanwhile, the union is ramping up relief efforts for Haiti's earthquake victims.

With the help of AFSCME International and Local 402's parent union in Boston, Conille said $35,000 or so has been raised so far for victims of the catastrophe.

"We're here right now as a union to show some solidarity to see if we can help the country get back on it's feet," Conille said.

In addition, the union of Fernald workers has started a drive to gather clothing and other needed supplies.

McKinnon said the union hopes to send someone to Haiti to help with the relief effort. That could include a union representative traveling to the country to purchase building materials there.

"Haiti needs to build from within, it needs to have construction materials bought from within, so it can help itself," said McKinnon, who is not from Haiti.

McKinnon, holding back tears, told the story of staying up until 3 a.m. to talk to console one woman Fernald worker who lost family members in the earthquake.

McKinnon pledged "every dime" that is raised by the local union would go toward the relief effort.

"We can't do for those that have passed, but we can do plenty for those who are living," McKinnon said.

Executive Branch managers and bargaining unit members of NAGE, MOSES, AFSCME and SEIU Local 509 will be receiving their 6th health care reimbursement in the September 30th paycheck.  The reimbursement will cover the increased amount of GIC copays and deductibles paid and processed in April, May and June of 2011.

9/23/11  Excitement at the pool today. An individual from the community had a seizure in the pool. Their staff panicked and called in a 911 emergency for a drowning in the pool.  This was picked up by the news trucks and before Fernald emergency responders were even notified the news trucks were swarming over Fernald.  Seems like we need a retraining for the ARC staff who are using our facility.

8/23/11  Local 402 union office will be moving from Withington building to the back of the Activity Center.Pending the approval of the Executive Board & Membership. Move date TBA.

Repot of the Atourny General for Fiscal Year 2001  P136:  Messac v. Department of Mental Retardation (U.S. District Court). Plaintiff claimed  that she was the victim of race discrimination at the Fernald School. Initially she alleged that she was disciplined more harshly than white employees. During trial, however, the court allowed her to her expand her case to include a racially hostile work environment claim. The jury found for DMR on her disparate treatment claim but awarded plaintiff$35,000 on her hostile work environment claim; DMR has appealed.

3/12/11 There is an ongoing and stubborn GAS LEAK @ the Marquardt Nursing Center.  National Grid was here on March 7th  and fixed one leak only to have another one open up this week.  Apparently the Gas Company isn’t too concerned because they said they will try to fix it NEXT WEEK.  We are not sure that the Director of Campus Safety should take his usual nonchalant attitude when it comes to GAS LEAKS on campus.  BTW NO SMOKING @ (outside) Marquardt

1/20/11   New dump site @ Fernald.  The City of Waltham has broken down the fence opposite the ball field on Paul MacDade way and put in a haul road into city property behind Site 5.  They have dumped and piled up snow with an excavator to the height of 30-40 ft.  When this melts it will probably impact Site 5 as well as the small adjacent wetlands.

12/20/10  Christopher Stepp and Kelly Feeney have been elected to fill vacancies on the executive board by unanimous vote of the e-board.

12/10/10  Paulette Song, a spokeswoman for the Executive Office of Health and Human Services stated (lied) in an artical in the Waltham Tribune; the department has “not deterred or blocked anyone from attending a funeral.”  We guess she didnt get the e-mail from the Deputy Commissioner:

10/17/10   Jill Lepore was elected to fill the vacant Recording Secretary seat by unanimous vote of the Executive Board.  Congratulations Jill!

11/9/10  There are new “gates” currently being installed at the front and back entrances to Fernald.. Rumor is that these “gates” will be controlled by access cards.  It appears the State has money to further isolate the Fernald Community but it doesn’t have money to fix the lights, phones and repair potholes.

10/23/10   DDS Management has lost another case.  An Arbitrator has just ruled that the termination of ICF 21 staff Marie J, was unjust.  The Arbitrator has ordered DDS to reinstate Marie immediately, with back pay.

10/16/10   There will be no election for the 2010 open Trustee Seat.  One candidate dropped out of the race which automatically makes Margaret Lauture the new Trustee for Local 402.

9/20/10  The manager / supervisor for the new Woburn House was overheard talking in a Woburn donut shop by a former 402 member.  She said  ”I cant wait to get rid of all these Fernald people.” We will be discussing this threatening and demeaning behavior with the Commissioner on Thursday.

9/10/10 A former Fernald client who was transferred to Hogan ran away and was eventually found in the corn field.  Seems that as of this time, Hogan administration does not actually have a lost client search policy.  Hogan did have a lost client search procedure before all Campus Police were laid off by Linda Montminy.  Staff have been told to keep this quiet.

8/17/10   The fire alarm panel in the lobby of Greene building is faulted out.  It shows a alarm situation on the 2nd floor at all times.  There are no plans to fix the alarm beyond disconnecting the buzzer in the lobby so it doesn’t annoy the management.

8/12/10   Linda Montminy and Diane Enochs entered the Union office uninvited and unannounced on Thursday afternoon.  Walking past the “UNION MEMBERS ONLY” sign they crashed in on a meeting of union officials and Lawyers.  This blatant act of Management interference opens the door for charges against the offending parties. We will keep you posted on the decision.

7/19/10  @Wrentham   Roof update: Wrentham Management is now claiming the leak at Heffron Hall is from staff improperly flushing wipes down the toilet and backing up the plumbing. (Thank God, we knew it couldn't possibly be a management planning error... wm)

7/14/10 @Wrentham  The "new" roof at Heffron Hall is leaking. Day Program was forced to be cancled for several days last week.

7/6/10    A retired Fernald staff who worked in the Administration building was observed "selling" Father Henrys oriental rug in the Chapel to Grillo Oriental Rug Co for $500

7/5/10 The Administrator for Marquardt was observed walking her dog on grounds by the Chapel about 3:30pm  Apparently the "No Dogs" sign at the front gate dosent apply to managers?

7/2/10  An elderly individual who was was just moved from the Cottages to Wrentham suffered a heart attack and he is currently recovering in the Wrentham Clinical Unit.  Wrentham has tried to blame Fernald, claiming we didn't move the individuals TV and this upset him.

6/21/10  President McKinnon has sent a letter of concern to Governor Deval Patrick regarding Management  abuses around the downsizing of Fernald.  A copy will be posted on line shortly.

6/1/10   It seems that Division 2 Manager John Hill will no longer be with us as of June 30, 2010, Fernald will be one division headed by Suzanne Kingston. No word yet how this will affect Supervisors.

5/15/10  The power plant which was scheduled to close on 6/30/10 has been given a one year extension until 6/30/11.  "We were eyeball to eyeball and the other guy just blinked" ...Secretary of State Dean Rusk

5/5/10  All the outside groups who use the pool and the Gym have been given notices that Fernald will close on June 30th and they must get out.  The athletic director from the High School was despondent when he showed up with a ladder to remove his score clock.

4/26/10  Fernald Facility Director Linda Montminy committed a racial faux pas in a Monday afternoon Labor / Management meeting by referring  to  union negotiators made up of minority staff  as "you people".

4/17/10  The windows at Heffron Hall are 40 years old but they are not going to be replaced as part of the renovation contract. DDS must feel that fresh air and draft free windows are overrated.

4/15/10  Deputy Commissioner Diane Enochs has produced her own "newsletter" called Fernald Update which was sent out to all the family members. .She touts the glorious placement options and wonderful experiences of those who have left.  She repeatedly tells families to hurry and decide.  We think she should just put out "Hurry up and leave, you are making me look bad."

4/14/10 A supervisor called Fernald manager, Kevin Buckley to report a critical office phone  out of service.  Mr. Buckley replied "If I see the phone man I will let him know" and hung up.  Further inquiry  revealed Local 402 has recently blocked an attempt by Mr. Buckley to pass his phone system responsibilities off to a 402 member. The phone is still out of service as of this date.

4/8/10   Judge Tauro has assigned a docket number for Deputy Commissioner Criss Oliveras to come befor his court and explain why she removed Anna T against her will from Cottage 11.

4/4/10  Judge Tauro has issued a one word response to the many motions made by the ARC Lawyers to dismiss the Anna T kidnapping incident.    "DENIED"

3/18/10  Comissioner Elin Howe paid a visit to Fernald today apparently she wanted to check out the Howe Librabry.  Ms Howe is more concerned about all the valuable books stored over there than the individuals who live over here.

3/13/10  During the layoff meeting, a Local 402 officer asked Diane Enochs ."How are services going to be delivered with all these people laid off?  Diane replied "We haven't figured that out yet."

3/10/10 Jonathan Platt the Director of Labor Relations  said in a meeting with Local 402 " I am sick of you people always complaining about racism.  I am not going to listen to it anymore."   Even though 85% of the "you people" being laid off are miniorty.. Mr Platt who makes a cool $88,556.96 per year he is not being laid off.

3/9/10 Gail Lawrence has been assigned to the ITP Team by Linda Montminny because Commissioner Howe is desperate over the prospect of family appeals of the ITP "process".  Gail is a former Service Coordinator and now the ITP Tem can hold two placement meetings per week.

The construction fences are up at Wrentham for the re-building of Heffron Hall (sp)  This is the place (two side by side buildings) DDS wants to move  Fernald residents into.

Josue Saint Fort
Of Brockton, died unexpectedly Sunday evening November 6th, 2011 in his residence at the age of 69.
Born on August 22, 1942 in the Port-Au-Prince, Haiti, son of the late Clement Saint Fort and Rose Antonia; Josue was a resident of Waltham for many years before moving to Brockton several months ago. Josue had been a supervisor at Fernald for many years before transferring to the Brockton Area Officee
